EUROPEAN UNION

Complies with food standards and purity criteria pursuant Commission Regulation (EC) Nos. 1881/2006, 1333/2008, 231/2012

EU Commission Regulation (EU) 2022/63 of 14 January 2022 amending Annexes II and III to Regulation (EC) No 1333/2008 of the European Parliament and of the Council as regards the food additive titanium dioxide (E 171);

ARTICLE 2: Until 7 August 2022, foods produced in accordance with the rules applicable before 7 February 2022 may continue to be placed on the market. After that date, they may remain on the market until their date of minimum durability or ‘use by’ date - click here

CURRENTLY: In response to the amended EU legislation, the Brew Glitter® Research & Development team has already developed and released a 100% EU compliant edible glitter for drinks & beverages product line that are available on our website. All colors & shades that are/ have been available in the US FDA compliant line, are also available in the EU compliant line. To satisfy the stance the EU has put in place on edible/ consumable ingredients when it comes to Red 3 and Titanium Dioxide (To2), we have developed an Edible Glitter that does not contain either “Titanium Dioxide (To2)” and/ or “Red 3 Food” coloring dye – as both ingredients are now on the restricted list in the EU. The best part is however, the EU compliant glitters we have developed still have the amazing "glittery" effect in drinks, cocktails, wine, beers and other beverages and that our US FDA complaint edible glitters have.

COMMON QUESTION: Can you make/ manufacture an edible flavored glitter color(s) that satisfies both the FDA and the EU compliance mandates/ standards, or do you have to purchase either and/ or both "EU compliant glitters" as well as "FDA compliant glitters"?

The short answer is no, there is not an edible glitter we manufacture that satisfies both FDA compliance standards as well as EU compliance standards - that would be great, but it is not possible. Our Food Safety Quality department (FSQ) has determined we cannot make ONE GLITTER product that satisfies both EU and FDA compliance regulations. In short, each government agency has contrasting views on ingredient approvals specific to how MICA is made and what constitutes MICA being an edible ingredient.

COMMON QUESTION: Are all of the same colors available in the EU version of the products as the FDA versions that you had/ have been selling on your website?

Yes, absolutely! All of the colors that have been available and are still available, are also available in the EU compliant versions! You can even request a custom color or shade, and we will make that too - and we can make it to either be EU compliant or FDA compliant, or both if needed!

OTHER INFORMATION: What about products that I had already purchased or have - what do I do with those products that no longer satisfy the EU compliance standards?

Interpreted, this means in the short term, products containing Titanium Dioxide e171 can continue to be purchased, inventoried and sold throughout the EU market up through August 7th, 2022. After the date of August 7th 2022, products containing Titanium Dioxide, E171 may continue to be sold in the EU market until their date of minimum durability or ‘use by’ date. For reference, our edible glitter products all have a minimum durability/ shelf life of 5+ years - companies in the EU that purchase our edible glitter, luster dust and highlighter dust products can continue to sell said products over the next 5 years, through 2027.

Alcohol and Tobacco Tax and Trade Bureau

Alcohol and Tobacco Tax and Trade Bureau (TTB, https://www.ttb.gov/)
The Bakell® sales teams and customer service teams frequently receive the question as to whether Brew Glitter® and/ or Brew Dust® products are approved by the TTB (https://www.ttb.gov/). Brew Glitter® and/ or Brew Dust® products are not alcoholic beverages nor are they tobacco products, therefore as a governing body/ agency we do not work with the TTB in any capacity. Brew Glitter® and Brew Dust® are both mica-based pearlescent "edible glitter" food products, and as such, we adhere to the FDA food ingredient compliance standards. If an alcoholic beverage company wants to use our edible glitter products as a raw material/ ingredient as part of their manufacturing/ production process, then said company would need to work with the TTB directly to get direction for approval for their specific alcoholic drink/ beverage.
